Why an attorney:

Many people are unaware that there are laws in place to protect consumers from harassing debt collectors. The Fair Debt Collections Practices Act is a federal law which outlines the following:

  • A debt collector can not contact you before 8 a.m. and after 9 p.m.
  • A debt collector can not contact you at work if they are aware that your employer does not approve of you receiving such calls.
  • They can not misrepresent themselves as an individual other than whom they truly are. (Examples: a lawyer, police officer, tax agent, etc.)
  • They can not use obscene or profane language.
  • They can not use unfair practices when trying to collect a debt.
  • (Examples: stating that they will have you arrested or put in jail.)
  • They must honor any written request you submit to them to stop contacting you.
